01The agreement
These terms are an agreement between you and Digipanda Consulting Private Limited, H-112, Sector 63, Noida, Uttar Pradesh 201301 ("EkQR", "we", "us"). By creating an account or using EkQR you agree to them, to the Privacy policy and to the Acceptable use policy. If you use EkQR for a business, you confirm you can accept these terms for it.
02Who can use it
You must be 18 or older and able to enter a contract. EkQR is a tool for businesses, creators and professionals; it is not meant for children.
03Your account
- Sign in with a phone number you control or a Google account. Keep access to them safe — whoever can sign in can act for your business.
- Give accurate details and keep them up to date.
- If you give anyone else access to your account, you are responsible for what they do in it.
- Tell us at [email protected] straight away if you think someone else has got into your account.
04What we provide
EkQR lets you publish a page for your business, create QR codes that point to it, and switch on tools such as menus, orders, bookings, reviews, payments links, WhatsApp and Instagram replies, analytics and AI drafting. Features differ by plan and may change as we improve the product. We aim to keep EkQR available all the time but cannot promise it will never be interrupted, for example during maintenance or problems at providers we rely on.
05Your link and your QR codes
- Your page address (ekqr.me/yourname) is yours to use while your account is open. We may change or reclaim a name that impersonates someone, infringes a trademark, misleads people, or is left unused on a closed account.
- QR codes you print point to EkQR, so you can change what they open without reprinting. If your plan ends, they keep opening a basic version of your page. If your account is closed or a page breaks these terms, they may show a notice instead.
06Your content
You keep ownership of everything you add — text, photos, menus, prices, logos and so on. You give us a licence to host, copy, resize, translate, display and send that content only as needed to run EkQR for you (for example, showing your menu to customers or posting a photo to your Google profile when you ask). The licence ends when you delete the content or close your account, except for copies in short-lived backups.
You confirm you have the right to publish your content and that it is accurate and lawful — including prices, taxes, offers, food and allergen information, licences (such as FSSAI where required) and anything else your business must show by law.
07You and your customers
- Orders, bookings, payments and services are between your business and your customers. EkQR is not a party to them and is not a seller, marketplace, payment collector or delivery service.
- Payments customers make through your page (for example UPI) go straight to your account. Refunds, cancellations, receipts and taxes for those payments are your responsibility.
- You are responsible for your customers' personal data that you collect through EkQR: use it only for your business, follow the law (including India's DPDP Act), and only send WhatsApp or other messages to people who agreed to get them. We process that data for you as described in the Privacy policy.
08Connected services
When you connect Google, Meta (WhatsApp, Instagram) or other services, their own terms and policies also apply, and their rules and limits (for example, message templates, rate limits or review policies) can change what EkQR can do. Unofficial or self-hosted WhatsApp connections carry a risk that WhatsApp restricts the number; you use them at your own risk after the warning shown in the app.
09AI features
AI drafts (review replies, captions, menu reading, auto-replies) can be wrong. Check them before you publish or send. You are responsible for what is published or sent from your account, including AI drafts you approve or automations you switch on.
10Plans, fees and taxes
- The free plan costs nothing. Paid plans are billed in advance for the period you choose and renew automatically until you cancel.
- Prices are shown in the app and on the Pricing page and include or add GST as shown. If we change a price we will tell you at least 30 days before it applies to your next renewal.
- Cancellations and refunds follow the Refund policy.
- If a payment fails, we may move your account to the free plan until it is paid.
11Rules of use
Follow the Acceptable use policy. In short: nothing illegal, fraudulent, misleading, harmful, infringing or spammy; don't try to break, overload or scrape EkQR; don't resell it without our written permission.
12Ending the agreement
You can close your account at any time by writing to [email protected]. We may suspend or close a page or an account that breaks these terms, puts people at risk or exposes us to legal liability — where we reasonably can, we will tell you first and give you a chance to fix it. After closing, you can ask for a copy of your data within 30 days.
13Our product
EkQR, its software, design, templates and brand belong to Digipanda Consulting Private Limited. These terms do not give you any right to them except to use EkQR as described here. If you send us feedback, we may use it without owing you anything.
14Disclaimers
We provide EkQR with reasonable skill and care, but "as is" and "as available". To the extent the law allows, we do not promise that it will be error-free or uninterrupted, that it will bring you any number of customers, reviews or sales, or that third-party services will keep working with it.
15Limits on liability
To the extent the law allows: we are not liable for indirect or consequential losses (such as lost profits, revenue, data or goodwill), or for what you, your customers or connected services do; and our total liability for any claim about EkQR is limited to the amount you paid us in the 12 months before the claim (or ₹1,000 if you are on the free plan). Nothing in these terms limits liability that cannot be limited by law.
16Your responsibility to us
If someone makes a claim against us because of your content, your business, your dealings with your customers or your breach of these terms, you will cover our reasonable costs and losses from that claim.
17Law and disputes
These terms are governed by the laws of India. Please write to [email protected] first — most problems are solved quickly that way. If not, the courts at New Delhi have exclusive jurisdiction, without taking away any rights consumer-protection law gives you.
18Changes
We may update these terms as EkQR grows. We will show the date of the latest version at the top and tell you about significant changes before they apply. If you keep using EkQR after that, the new terms apply; if you don't agree, you can close your account.
